Terms of Service

1. Who May Use Kiddoz

You may use the Service only if:

• You are 18 years or older,
• You have the authority to act on behalf of a school, educational centre, or child's family,
• You agree to these Terms and all applicable laws.

The Service is intended for schools, teachers, and parents/guardians. Children do not create accounts on Kiddoz.

2. Your Account

You must provide accurate information when creating an account and keep your login credentials secure. You are responsible for any activity that occurs under your account.

We may suspend or terminate accounts that:

• Violate these Terms
• Pose security or privacy risks
• Are involved in misuse, abuse, or unauthorised access

3. School Responsibility & Parental Consent

Schools using Kiddoz are responsible for:

• Determining the lawful basis for processing children's personal data
• Obtaining parental/guardian consent for sharing photos, videos, and updates
• Managing user access for teachers and families
• Ensuring uploaded content is appropriate and lawful

Kiddoz (operated by HOW GP) acts as a data processor for child-related content and follows the instructions of each school.

4. Content Uploads

Schools and teachers may upload photos, videos, and classroom updates ("Content"). Parents may view and interact with Content related to their child.

By uploading Content, you confirm that:

• You have the right to share it
• It does not violate anyone's privacy rights
• It does not contain harmful, illegal, or inappropriate material
• It complies with school policies and local regulations

Kiddoz does not claim ownership over your Content.

However, you grant us a limited, revocable licence to store, process, and deliver Content solely to provide the Service.

We may remove or restrict Content that violates these Terms or poses risks to children or families.

5. Prohibited Uses

You agree NOT to:

• Upload abusive, harmful, or unlawful material
• Share login credentials with unauthorised persons
• Use screenshots or downloads to distribute Content outside the intended school community
• Attempt to reverse engineer, scrape, or disrupt the Service
• Use Kiddoz for commercial advertising or unrelated communication

Kiddoz maintains a zero-tolerance policy for behaviour that compromises child safety.

6. Service Availability

We aim to provide a reliable and uninterrupted Service, but:

• We may temporarily suspend access for maintenance or updates
• We do not guarantee 100% uptime
• We are not liable for delays or failures caused by internet issues, hosting providers, or force majeure events

We continually work to maintain high security and availability standards.

7. Payments & Subscriptions (If Applicable)

If your school or family upgrades to a paid plan:

• Fees and billing terms will be clearly presented
• Charges are non-refundable unless required by law
• Paid features require continuous payment to remain active

We may modify pricing or plans with prior notice.

8. Termination

You may delete your account at any time.

Schools may request full deletion of their workspace, including child data.

We may suspend or terminate your account if:

• You violate these Terms
• You misuse the Service or jeopardize child safety
• Required security or legal requirements cannot be met

Upon termination, access to Content may be permanently lost.

9. Intellectual Property

The Kiddoz name, logo, design, software, and all associated intellectual property are owned by HOW GP or its licensors.

You may not:

• Copy, distribute, or modify the Service
• Use our trademarks without written permission
• Build competing products using proprietary elements of Kiddoz

10. Privacy

Your use of Kiddoz is also governed by our Privacy Policy, which explains:

• What data we collect
• How we use and protect it
• Your rights under GDPR

By using the Service, you acknowledge that you have read and understood the Privacy Policy.

11. Limitation of Liability

To the maximum extent permitted by law, HOW GP:

• Is not liable for indirect, incidental, or consequential damages
• Does not guarantee uninterrupted or error-free service
• Is not responsible for Content uploaded by users or schools

In all cases, our total liability is limited to the amount paid (if any) in the 12 months preceding the claim.

Nothing in these Terms limits liability where not permitted by law (e.g., fraud, gross negligence).

12. Indemnification

You agree to indemnify and hold harmless HOW GP and its personnel from claims arising from:

• Your misuse of the Service
• Your violation of these Terms
• Content you upload or share
• Your failure to obtain proper rights or consent

13. Changes to the Terms

We may update these Terms from time to time.

If we make material changes, we will notify users and schools before they take effect.

Continued use of the Service after an update constitutes acceptance of the new Terms.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of Greece.

Any disputes will be resolved exclusively by the competent courts of Athens, Greece, unless otherwise required by applicable law.
